The legal agreements between us and our clients.
1. COPYRIGHT
1.1 The Agency retains the entire copyright on the Photographs, Films, and other works at all times, throughout the world.
1.2 Where reproduction of Works has taken place and settlement has not been made, the Photographer will make such charges to the publisher of those images as falls within the Copyright Act 1957.
2. DISPLAY
2.1 The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and promote the business in various media forms including advertising, social media, brochures, and websites.
3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
3.1 Photographs taken during the event will be at the discretion of the photographer.
3.2 Special requests are not binding instructions; however, efforts will be made to fulfill them.
3.3 For certain venues, the photographer’s movements may be restricted by the venue’s official.
4. PAYMENTS
4.1 Client(s) agrees to pay according to the selected payment module.
4.2 One time complete payment: A non-refundable booking fee of 20% will confirm the booking, and full payment is required within 15 days.
4.3 Part payments (50%-50%) are allowed with payment deadlines as per the contract.
5. EXPENSES
5.1 Extra expenses incurred due to changes by the Client(s) will be covered by the Client.
5.2 Photography beyond 8 hours will be charged an additional ₹10,000 per hour.
6. ON THE DAY
6.1 The photographer will be the sole professional photographer at the event.
6.2 No photos will be taken during the wedding breakfast; the photographer will take a break.
7. FAILURE TO PERFORM
7.1 In case of illness or any unforeseen event, the photographer will attempt to procure another professional photographer.
7.2 If no replacement photographer is available, fees paid will be returned, and no further liability will be taken.
8. CANCELLATIONS or POSTPONEMENT
8.1 If the Client cancels or postpones the assignment, they will be liable to pay a certain percentage of the fees based on the cancellation time.
8.2 Full fee and additional charges will apply if the assignment is rescheduled.
9. DELIVERY
9.1 Digital negative files will be delivered within 4-6 weeks.
9.2 Final deliverables may take up to 4-6 months depending on the work volume.
10. DELIVERABLES
10.1 Processed or Edited pictures will be provided as per the agreed timeline.
10.2 Photos for album printing must be selected within 14 days of receiving the selection invite.
11. TEMPORARY FREEZE OF ASSIGNMENT
11.1 If payments are delayed, the project will be temporarily frozen until the client clears the pending payments.
12. ARCHIVING DIGITAL FILES
12.1 The client is responsible for archiving the images; the photographer will not guarantee their availability beyond the initial delivery.
13. PRINT QUALITY
13.1 While high-quality materials are used, the photographer is not responsible for fading or discoloration over time.
14. ELECTRICITY OUTLET AND PLACE FOR EQUIPMENT
14.1 A 5amp/220-230 volt electricity supply with a table will be needed for the photographer’s equipment setup.
15. ACCEPTANCE OF TERMS
15.1 By using the services, the client agrees to these terms and conditions.
